in Commercial Real Estate Lending 


Please join CREFC and Kelley Drye & Warren LLP on Tuesday, October 22nd, for an After-Work Seminar on the importance of identifying and boxing environmental risks in various types of commercial real estate lending transactions, including CMBS and balance sheet loan originations and warehouse financing.  The panel will discuss all aspects of identifying, quantifying, and mitigating environmental risks. Topics will include:

  • Necessity of conducting independent lender environmental due diligence
  • Commonly identified environmental risks
  • Quantifying environmental risks
  • Strategies for mitigating environmental risks and protecting security interests
  • Addressing typical environmental-related securitization requirements and representations
  • Potential consequences of failing to identify, quantify and mitigate environmental risks, including impaired collateral value and negative impact on CMBS ratings
  • Avoiding lender liability under environmental laws
